McNulty Casting Master Privacy Policy

Effective Date: September 1, 2026

This Privacy Policy explains how McNulty Casting, Inc., doing business as McNulty Casting (“McNulty,” “we,” “us,” or “our”), collects, uses, discloses, and retains personal information through Project-specific casting websites, accounts, applications, audition services, messaging, electronic signatures, and related services (the “Service”). A Project may also provide a supplemental notice. Project Parties receiving information have their own privacy practices and notices.

1. Information We Collect

Information you provide: name; email; telephone number; date of birth or age; home or mailing address; location; gender identity or pronouns; union status; social-media handles; representation information; application answers; eligibility information; messages; headshots; photographs; audition video and audio; linked-video URLs; biographical and professional information; consents; releases; electronic signatures; and other information you submit.

Casting information: staff and production reviews, ratings, decisions, tags, notes, communications, scheduling information, Project assignments, and records of prior or potential future casting consideration.

Account and signature records: email verification events, access codes or links, document versions, signature audit information, dates, times, IP addresses, and related authentication and consent evidence.

Automatically collected information: IP address; device, browser, and operating-system information; page and feature activity; referring URLs; approximate location derived from IP; cookie and local-storage identifiers; security and rate-limiting events; server and application logs; and interaction with emails.

Information from other persons: an authorized representative, parent or guardian, another applicant, a Project Party, or another person who submits or confirms information about you. We do not purchase applicant profiles from data brokers.

2. How We Use Information

We use personal information to create and secure accounts; verify age and eligibility; administer applications, releases, electronic signatures, auditions, and virtual queues; communicate with applicants; evaluate applicants; create casting notes and decisions; disclose information to Project Parties; consider applicants for the applicable Project and appropriate future Projects; preserve consent and rights records; operate, secure, debug, and improve the Service; prevent fraud and abuse; comply with law; resolve disputes; and protect rights and safety.

We do not use audition videos for facial recognition, voice recognition, biometric identification, emotion analysis, or automated applicant scoring. A staff search tool may send a staff-written generic search instruction to an AI provider to translate it into database filters; applicant records are not sent to that provider.

3. How We Disclose Information

Project Parties. We disclose applicant profiles, Submissions, releases, casting notes, decisions, messages, and related information to producers, networks, studios, streaming services, broadcasters, distributors, executive producers, casting personnel, and their respective direct and indirect parents, subsidiaries, related and affiliated entities, divisions, business units, successors, assigns, and other entities associated with the applicable Project or another Project for which the applicant may be considered. A Project may remain confidential when an application is submitted.

Service providers. We use vendors that provide cloud hosting and storage, database services, content delivery, video processing, email delivery, rate limiting, monitoring, encryption and key management, DNS, marketing email, analytics, advertising, source-code hosting, and linked-video playback. Current providers may include Amazon Web Services, Upstash, Intuit/Mailchimp, Google, Meta, Anthropic, GitHub, YouTube, Vimeo, and their applicable affiliates.

Legal, safety, and business purposes. We may disclose information to comply with law or legal process; protect people, rights, property, and the Service; investigate abuse; obtain professional advice or insurance; or complete a merger, financing, reorganization, sale, or transfer subject to appropriate protections.

We do not sell applicant information for money. Advertising or analytics technologies may constitute a “sale,” “sharing,” or targeted advertising under some state laws even when no money changes hands. Where applicable, you may opt out through “Your Privacy Choices” and supported browser signals.

4. Cookies, Advertising, and Analytics

We use cookies and similar technologies that are necessary for sign-in, session management, security, preferences, and Service operation. Public informational pages may use Google AdSense. We may deploy Google Analytics 4 with Google Signals disabled and may deploy the Meta pixel for limited adult conversion measurement, subject to applicable opt-out and Global Privacy Control requirements. These tools must not receive audition content, application answers, contact information, or sensitive information through event parameters or URLs.

You can adjust browser settings, email info@mcnultycasting.com with the subject line “Privacy Opt-Out,” or send a supported Global Privacy Control signal. Disabling necessary technologies may prevent the Service from working. Linked YouTube, Vimeo, Instagram, or similar content is loaded from that platform and may be governed by its cookies and privacy practices.

5. Marketing Communications

Transactional emails are necessary for account access and casting administration. Marketing email is optional. If you separately opt in, we may send your name, email address, and general interest tags to Mailchimp. You may unsubscribe from marketing at any time. We do not enroll known children under 13 in marketing lists.

6. Data Location and Security

McNulty’s primary applicant databases and stored files are hosted in the United States in AWS us-west-2. We use safeguards designed to protect information, including encryption at rest, encryption-key management, access controls, monitoring, and security logging. No system is completely secure, and we cannot guarantee absolute security. Project Parties and linked third-party platforms may process information under their own systems and notices.

7. Retention

We retain each category for as long as reasonably necessary for the purpose collected, including casting consideration, future casting where appropriate, account administration, production requirements, security, consent and rights documentation, legal compliance, and dispute resolution. Relevant criteria include account activity; Project duration; whether an applicant remains eligible for future consideration; production instructions; contractual and legal limitation periods; the need to preserve signed releases and audit records; deletion requests; and backup cycles.

Uploaded videos may transition to lower-cost archival storage after 30 days without access. Moving information to archival storage is not deletion. When information is deleted from active systems, residual copies may remain in backups until overwritten under the applicable backup cycle. We may retain a limited record of a deletion request and signed releases or consent evidence when reasonably necessary to establish legal rights, comply with law, or resolve disputes.

8. Privacy Rights and Requests

Depending on your state, you may have rights to request access, confirmation, correction, deletion, portability, a list of certain third parties, or an opt-out of sale, sharing, targeted advertising, or certain profiling. You may also have a right to appeal a denied request and not be discriminated against for exercising a right.

Submit requests by email to info@mcnultycasting.com. We will verify requests using commercially reasonable methods, ordinarily by a one-time code sent to the account email and, when necessary, additional information. Authorized agents must provide authority and may be subject to verification. A parent or guardian may submit a request concerning a minor. We will respond under applicable law and may deny or limit a request where an exception applies.

9. California Disclosures

Based on its current size and practices, McNulty does not presently expect to qualify as a covered “business” under the California Consumer Privacy Act. Whether or not a particular state privacy law applies, McNulty offers the request methods described above, subject to verification, legal exceptions, and operational feasibility.

McNulty uses and discloses these categories for the purposes and to the recipient categories described in this Policy. McNulty does not use sensitive personal information to infer characteristics outside the disclosed casting purposes. McNulty does not knowingly sell or share personal information of persons under 16 without legally required authorization.

10. Minors

The Voice is limited to applicants at least 13 years old. Applicants under 18 require parent or guardian involvement and the applicable parental consent. A future Project may accept children under 13 only through a separate parent-controlled process that provides direct parental notice and obtains verifiable parental consent before collection. Parents may request access to or deletion of a child’s information and may refuse further collection or use, subject to lawful retention exceptions. We do not require a child to disclose more information than reasonably necessary to participate. Under-13 information will not be retained indefinitely and will be deleted when no longer reasonably necessary for the specific purpose for which it was collected.

11. Changes

We may update this Policy. We will post the new effective date and provide additional notice or obtain consent where required for a material change.
